Donald Trump is resisting the release of dozens of heavily redacted footage related to special counsel Jack Smith’s detailed 165-page brief, which laid out an election sabotage case and insists the former president is not immune from prosecution.
“There should be no other revelations regarding improper presidential immunity filings at this time of what the Office of Special Counsel illegally cherry-picked and misclassified as ‘evidence’ during early voting in the 2024 presidential election. There is no basis in criminal procedure or judicial precedent.” Trump said in a court filing Thursday.
Earlier this month, the special counsel revealed never-before-seen information in the federal investigation into Trump’s election reversal schemes. Smith’s team previously said it would offer grand jury testimony, notes from FBI interviews and other materials as exhibits for the judge to review. However, those sensitive materials will continue to be shielded from public view.
Judge Tanya Chutgan could release the redacted footage at any time as Trump made his position known on the amendments.
Trump argued that even if Sudgan wanted to release the exhibits, he should consider appealing the ruling.
Compared to Smith’s minimally redacted 165-page brief, the redactions proposed by prosecutors are expected to preserve the most important testimony in the case and include evidence that was already public. Sphere.
The special counsel’s office previously indicated that for the exhibits, they had “completely redacted non-public sensitive material” and that they had redacted some previously-public material, such as the identities of individuals targeted at Trump. Tweet to protect potential trial witnesses from threats and harassment.
Sutgen is currently weighing how well Smith’s reworked case against Trump survives under the Supreme Court’s exception ruling handed down this summer, which said presidents have at least some immunity for official conduct.
Trump will file his response to Smith’s arguments on Nov. 7.
